Agreement
These Terms of Service ("Terms") govern your access to and use of SiteControlHQ. By creating an account or using the service you accept these Terms on behalf of your company workspace and represent that you are authorized to do so.
Eligibility & accounts
You must be at least 18 and provide accurate account information. You are responsible for safeguarding credentials and for all activity under your workspace, including your users and subcontractors.
Subscriptions & billing
Paid plans bill in advance on a recurring basis (monthly unless stated otherwise) via our payment processor. Fees are exclusive of taxes. Your subscription renews automatically until cancelled. Feature access may be gated by plan and an active subscription.
Free trials
If offered, trials convert to a paid subscription at the end of the trial period unless you cancel beforehand. We may modify or withdraw trials at any time.
Acceptable use
You agree not to misuse the service, including: violating law; infringing others' rights; uploading malware; attempting to breach security or access other workspaces; scraping; or reselling the service. You are responsible for the accuracy and legality of records you generate.
Customer data & ownership
As between the parties, your workspace owns the content it submits. You grant us a limited license to host and process that content solely to provide and improve the service. We own the software, platform, and all related intellectual property.
Source of truth
A signed field estimate or change order is the operational source of truth for work authorized on site; connected accounting ledgers (QuickBooks Online, Xero) are the financial system of record. You are responsible for reconciling the two.
Third-party services
The service integrates with third parties you choose to connect (e.g., Stripe, QuickBooks Online, Xero, Twilio, Google). Your use of those services is governed by their terms, and we are not responsible for their acts or omissions.
Service availability
We work to keep the service available and support resilient offline operation, but we do not guarantee uninterrupted or error-free service. We may modify, suspend, or discontinue features with reasonable notice where practicable.
Disclaimers
The service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including merchantability, fitness for a particular purpose, and non-infringement. AI outputs are assistive only.
Limitation of liability
To the maximum extent permitted by law, SiteControlHQ will not be liable for indirect, incidental, special, consequential, or punitive damages, or lost profits or data. Our aggregate liability is limited to the amounts you paid us in the 12 months before the claim.
Indemnification
You agree to defend and indemnify SiteControlHQ against claims arising from your content, your use of the service, or your violation of these Terms or applicable law.
Termination
You may cancel anytime; access continues through the paid period. We may suspend or terminate access for breach or risk to the service. On termination you may export data for a limited period, after which it may be deleted.
Governing law
These Terms are governed by the laws of the State of Texas, USA, without regard to conflict-of-laws rules. Disputes will be resolved in the state or federal courts located in Texas, unless applicable law requires otherwise.
Changes
We may update these Terms; material changes will be posted here with a new effective date. Continued use after changes constitutes acceptance.
